Brookfield Driver 'Goes Yard,' But It's Not a Home Run

A 50-year-old Brookfield man has been charged for his fourth time with drunken driving after reckless and dangerous incidents on a recent afternoon near a school bus stop. His abusive and threatening behavior toward several citizens led to additional charges.

Kevin P. McMullen was charged Monday in Waukesha County Circuit Court with his fourth OWI within five years, making it a felony count, and with disorderly conduct and driving under revocation. If convicted on the operating while intoxicated charge alone, he would face up to six years in prison.

According to the criminal complaint:

The incident began Friday afternoon when McMullen pounded on the door of a home in the 500 block of Green Meadow Drive. A 15-year-old girl answered the door, and McMullen immediately began ranting and swearing at her about her father not taking care of keeping his driveway plowed.

The girl saw that McMullen, whom she did not know, had actually driven his Honda Civic into her family's front yard, where it was stuck. She called her father about what was going on, then went upstairs to watch out her window. She saw McMullen back his car out of the yard and then witnessed the following confrontation from the window:

At 3:44 p.m., another resident called police about McMullen who, he said, had veered over in front of him and stopped while he was waiting at Green Meadow and Emerald drives for his grandchildren to arrive on a school bus.

McMullen got out and walked back to his vehicle, the witness said, and began screaming at him and pounding on his window. He said McMullen told him to get out so he could rip his head off, tear his arms off and bury him in the snow.

That victim backed up and drove around McMullen, but McMullen, he told police, chased him, passed him and blocked him again farther along Green Meadow. The victim again manuveured away onto Brookfield Road where he called 911.

When police arrived, they found McMullen back at the home he had been at before, now engaged in a heated argument with the girl's father, whom McMullen was still accusing of failing to keep his driveway cleared. The homeowner, like his daughter, would tell police he was not even acquainted with McMullen.

McMullen continued to complain loudly to police officers that he had gotten stuck because the homeowner failed to clear the snow. Police noticed the tracks in the middle of the yard and smelled a strong odor of alcohol on McMullen's breath.

Learning of his record of three previous OWI convictions and his revoked status, and because of his belligerent and erratic behavior, they took him to Elmbrook Memorial Hospital for sobriety tests.

McMullen, however, refused to participate, and was arrested and required to give a mandatory blood sample. The results of the test had not been returned at the time of charging, but police and the district attornery felt they had ample evidence to file.
