Brookfield Man Faces Felony Charges After His Passenger is Placed Under Arrest

Suspect had heroin in his pants while driving a car owned by a woman with an outstanding arrest warrant.

A 23-year-old Brookfield man is facing felony drug charges after he was caught driving a woman’s car who had a warrant out for her arrest.

Kyle G. Day was charged in Tuesday with one count of possession of narcotic drugs, one count of possession of drug paraphernalia, one count of operating a motor vehicle after revocation of his license and one count of felony bail jumping. If convicted, he could face up to 10 years and seven months in prison, and $23,000 in fines.

At 12:23 p.m. Monday, a Pewaukee police officer on patrol saw a car filling up at a gas station in the 700 block of West Wisconsin Avenue and after checking the plates he discovered the owner of the car had a warrant out for her arrest. He looked in the car and then noticed a female passenger in the car that matched the description of the owner.

The officer then pulled the vehicle over a short time later, which was being driven by Day. The female passenger gave the officer a fake name, but later admitted to indeed being the person who has the warrant out for her arrest.

The officer then re-approached Day who still insisted the arrested woman had a different name, so he was then placed under arrest for obstructing an officer. The officer then searched Day and discovered a small bag in his pants that contained heroin and items used for cooking the drug.

The officer also discovered Day has a current felony strangulation charge pending against him and as part of that case was ordered to not have contact with the woman who was in the vehicle with him.
