Woman Charged with Brookfield Murder Investigating Insanity Plea

The attorney for accused murderer Lynn Hajny says he will determine in the next month if she will plead not guilty by reason of insanity.

A defense attorney for a woman facing charges in the brutal murder of a Brookfield businessman said he should determine in the next month if she will plead not guilty by reason of insanity.

Attorney Michael Hart told Waukesha County Circuit Judge Patrick Haughney Tuesday that he was still working to track down all of the past mental health records for Lynn Hajny, 49, to determine if she qualifies for the plea. Hajny also has also met with a doctor who is evaluating her mental health status, Hart added.

Hajny is charged with one count of being party to first-degree intentional homicide. A criminal complaint alleges she and her boyfriend Tommy Douyette, 42, killed John Aegerter, 63, inside his Brookfield residence last June.

and was convicted of a reduced felony charge of first-degree reckless homicide under a plea deal with prosecutors. Prosecutors will recommend Douyette serve 35 years in prison, followed by 15 years on extended supervision.

Hajny’s trial was slated to begin Monday, May 7. But to accommodate the testimony of a detective in the case who will be on vacation that week, Haughney scheduled jury selection to begin Thursday May 3 with opening arguments and the detective's testimony on May 4.

Hajny will return to court March 1 to allow Hart to provide an update on the potential insanity plea.
