Facsimile Handgun Creates Scare in Brookfield Business Parking Lot, Police Say

A Milwaukee man is accused of pointing a BB gun that resembled a semi-automatic handgun in his former brother-in-law's face in Brookfield, according to a criminal complaint.

A Milwaukee man is accused of confronting his former brother-in-law by pointing a BB gun at the brother-in-law at his workplace in  on Aug. 16.

John M. Binter, 32, was charged Thursday in Waukesha County Circuit Court with negligent handling of a weapon, disorderly conduct and carrying a concealed weapon. He faces nearly eight years in prison if convicted because he previously was convicted of battery to a law enforcement officer.

Binter’s former brother-in-law said he was walking to his car at Guhring, 1505 Commerce Ave., when Binter told him to “get the (expletive) out of the car” and showed him his pistol, according to the complaint.

The man told police he was worried Binter would shoot him because Binter pulled out the gun and was pointing it in his face, the complaint states. The man was trapped and unable to run away.

“You’re (expletive) with the wrong person,” Binter yelled at the man, according to the complaint.

The man managed to get away well yelling to a co-worker, “he’s got a gun, call the police,” the complaint states. The man’s co-workers confirmed his story, both confirming Binter pulled the gun on his former brother-in-law.

Binter was pulled over and he admitted he had a BB gun that resembled a semi-automatic handgun. The gun was thrown out the window near Barker Road and was recovered by police, the complaint states.

Binter told police he wanted to scare his former brother-in-law while confronting him about the man’s treatment of a relative. He used a BB gun for protection because “getting shot with a BB gun hurts,” he told police, according to the complaint.

Binter has threatened the man since 2003 when he married Binter’s sister. Binter spent most of his adult life in jail, the complaint states, and Binter threatened to “shoot (the former brother-in-law) in the throat and watch him bleed slowly.”
