Man Accused of Exposing Self in Mall Food Court

A 44-year-old Milwaukee man is facing charges after he was allegedly masturbating in the food court at while watching children.

Kevin S. Smith was charged in Waukesha County Circuit Court Thursday with one count of lewd and lascivious behavior after a mall kiosk employee spotted him masturbating. If convicted, he faces up to nine months in prison and $10,000 in fines.

According to the criminal complaint, on March 28 the employee was walking through the food court with a security guard when two shoppers approached them and said Smith was masturbating while sitting at a table.

The guard didn’t want to alert Smith he was watching, the complaint states, so he sent the kiosk employee to see what was happening. The employee then allegedly spotted Smith masturbating while sitting at a table and drawing on a notepad with his other hand.

Smith was arrested at a later date, the complaint states, after Brookfield police officers were able to identify him.

Smith made his initial appearance in Waukesha County Circuit Court Thursday. His bail was set at $1,000.
