Man Charged With 3rd OWI Had Young Son in the Car
Suspect initially denied drinking, but later admitted to it and taking Xanax prior to driving, a criminal complaint alleges.
A New Berlin man allegedly drove drunk through Brookfield with his 9-year-old son in the car, a criminal complaint alleges.
Brian E. Delmore, 52, was charged in Waukesha County Circuit Court Tuesday with one count of third offense operating while intoxicated with a minor in the vehicle.Β

At 5:47 p.m. Friday, Brookfield police were called after someone reported Delmore was driving recklessly on eastbound I-94 before exiting at Moorland Road and driving southbound. An officer tried to pull over Delmore's vehicle as it crossed Greenfield Avenue. But Delmore continued to drive with the window down until he pulled over shortly thereafter.
Delmore had chewing tobacco in his mouth and denied he had been drinking. He failed a field sobriety test, registered a blood alcohol level of 0.064 and told officers he had taken Xanax.

Delmore was previously convicted of OWI in 1997 and 2001.Β
