Man Rubs Face on Squad Car, Spits on Officer, Complaint Says

Brookfield man faces a felony charge after a run-in with New Berlin police officers.

A 29-year-old Brookfield man, who was rubbing his face and banging his head against a New Berlin police car, now faces a felony charge after spitting twice onto a police officer, according to a criminal complaint.

Aaron M. Guenther was charged Tuesday in Waukesha County Circuit Court with dispelling bodily fluid on a public safety worker. If convicted, he faces up to a 1.5 years in prison and $10,000 in fines.

Guenther’s troubles started around 6 p.m. Sunday when New Berlin police officers were asked to remove a disorderly, intoxicated man from Senor Luna’s parking lot in the 1900 block of South Calhoun Road, the complaint states.

New Berlin police officers attempted to help Guenther get a ride home from the business, but he refused to cooperate or give them names of a responsible person, the complaint states.

While they were talking to him, Guenther began to rub his face on the side of a squad car and then banged his head against the squad car before falling down, according to the complaint. Officers caught him before he hit the ground. They took him into custody for an emergency medical clearance at Waukesha Memorial Hospital.

Guenther called the paramedics and officers assisting him derogatory names before he was transported to the hospital. During the ride, he spat on the officer’s hand and leg and a spit hood was placed over his face, according to the complaint.

At Waukesha Memorial Hospital, Guenther was placed in restraints after he tried to kick the nurses, the complaint states.

Guenther is ordered to not possess or consume alcohol while on bail. He returns to court for a preliminary hearing on July 26.
