Prosecutors Probing Possible Third Person Involved in Brookfield Murder

But prosecutors won't say if charges might be filed against anyone else in June murder of John Aegerter.

The Waukesha County District Attorney’s office is looking into evidence that might suggest there was a third person involved in the murder of Brookfield businessman .

At a court hearing Monday for Tommy V. Douyette and Lynn Hajny, who are , Assistant District Attorney Jennifer Lough told a judge that prosecutors have provided more discovery evidence to defense attorneys in the case about the possibility of the involvement of another individual.

After the hearing, Lough would not comment on whether charges will be filed against anyone else in connection with the case, however.

Douyette and Hajny each have been charged with one first-degree intentional homicide after Aegerter was found murdered in the garage of his Brookfield home in June. According to the criminal complaint, Douyette killed the victim after he and Hajny went to Aegerter’s home to collect money they said he owed to Hajny’s husband.

Aegerter’s ankles were tied with electrical tape and his face was covered with duct tape and head covered with several plastic bags and an electrical cord was wrapped around his neck.

After Aegerter was killed, Douyette and Hajny planned to dissolve his body in hydrogen peroxide.

Defense attorneys Michael Hart and Jonathan Smith will review the additional evidence, and Douyette and Hajny will return to court Oct. 28 before Waukesha County Circuit Court Judge Patrick Haughney.

A jury trial was set for Jan. 30.
