Woman Faces Drug Charges After Fatal Heroin Overdose

Amy M. Kaebisch faces drug charges after Justin Martinez was found unconscious with a needle in his arm in the 800 block of Scott Avenue, according to criminal complaint

A 34-year-old Waukesha woman is facing charges after a man she was living with overdosed and died after they took heroin Saturday night.

Amy M. Kaebisch was charged in on Wednesday with one count of possession of narcotic drugs, two counts of bail jumping, one count of possession of an illegally obtained prescription drug and one count of possession of drug paraphernalia. If convicted, she faces up to 5 ½ years in prison and $31,000 in fines.

According to the criminal complaint:

Early Sunday morning, Waukesha police were called to an apartment in the 800 block of Scott Avenue after Kaebisch found "Lil Demon" unconscious after overdosing on heroin. She told officers they had injected the drug twice on Saturday and after the second dose, she went to bed thinking Martinez came with her. However, Kaebisch woke up later to find him unconscious with a needle sticking out of his arm.

Kaebisch took the needle out of his arm before officers arrived and stashed it in a drawer where officers found baggies of white powder believed to be drugs. Officers searched the apartment and also found a heroin cooker and numerous pills.

Martinez had no pulse and wasn’t breathing and was later pronounced dead. Kaebisch changed her story drastically for police, first saying she injected Martinez with heroin, then saying he injected himself with the fatal dose.

She’s currently free on $500 bond while awaiting trial.

they are both fools for touching the stuff in the 1st place. Losers do that stuff, so guess what lock her up and throw away the key. She is a dead beat mom anyway!!!

So, it's been almost FIVE months since this kid died from a heroin overdose that Ms. Kaebisch ADMITTED to giving him and somehow, she's out on bail and not being made to properly pass urine tests and hasn't been charged with his death!!! Can someone please explain to me how this happens??? When did it become okay to be a party to a death by use of drugs, continue to do drugs and not follow conditions of a measly SIGNATURE bond?!?! This poor excuse of a woman has to pay for what she's done and be sent to PRISON for quite a few years!!!!! Where is the justice?! Where is the punishment for wrong doing?!

I agree 100% with the comment above... its going on a year, and she still is out free doing drugs.. why?!!? SMDH @ our "wonderful" court system!

Is this case still going on i just seen this chick last week..she was at the hope center she looked a mess like she was using
