Developer Will Seek to Build More Homes in The Shire

Developer Joseph Niebler plans to ask for city approval for more home sites in The Shire subdivision.

Brookfield developer Joe Niebler will ask for city approval to develop 16 more home sites in The Shire subdivision, according to a Business Journal report.

Business Journal reporter Sean Ryan detailed Niebler's plans for outlots that have been under a building moratorium since 2004.

The moratorium was in place during state testing for potential contamination problems stemming from a closed Waste Management landfill.

A city committee monitoring the site last month asked the Common Council to disband the committee and follow the state's recommendations in a report, according to this .

The state recommended that Waste Management install a mitigation trench and build a retaining wall. Any new outlot development, the state said, should include sub-slab vapor mitigation systems with a liner, coarse gravel base, perforated piping, a sealed sump and fan.

Aldermen voted Tuesday night to dissolve the committee and use the state findings in considering any future building plans that Niebler files.

Niebler's subdivision plat drawings may be on the Plan Commission's Nov. 7 agenda, City Planning Administrator Michael Theis has said.

The state Department of Natural Resources is preparing a groundwater study that may not be submitted to the city until early 2012 that also could influence future development of The Shire.
